1. Rigid Metallic Dryer Venting Mandate
For all electric and gas clothes dryers sold, installed, or maintained by Hermes Services LLC, the company strongly recommends the exclusive use of rigid metal venting systems. Customers acknowledge that plastic, vinyl, or flexible foil ducts may create elevated fire hazards, restrict airflow, reduce efficiency, and void manufacturer warranties.
If a customer declines compliant metal venting installed by Hermes Services LLC, they waive that installation option and agree to release and hold Hermes Services LLC harmless for resulting liability, property loss, injury, or claims tied to non-compliant self-installed or legacy ducts, except in cases of gross negligence or intentional misconduct.
2. Gas, Water, and Utility Interface Infrastructure
Appliance installation may require connection to existing water and gas infrastructure, including removal of aged lines, valves, and couplings. Hermes Services LLC is not responsible for failures of pre-existing shut-off valves, corroded pipes, or underlying household threaded infrastructure.
Customers are responsible for monitoring the property after service and must notify Hermes Services LLC immediately if leaks occur. Property damage or remediation costs tied to legacy valve or line failures are released, except where caused by gross negligence or explicit worker misconduct.
3. Food Spoilage Disclaimer
Hermes Services LLC assumes no liability for spoilage, degradation, or loss of food, pharmaceuticals, or other organic products stored in refrigerators, coolers, or freezers undergoing repair.
The homeowner is solely responsible for monitoring temperatures, checking power supply, and confirming safe operating conditions before returning perishable items to the appliance.
4. Pre-Existing Damage Acknowledgement
Hermes Services LLC is not responsible for cosmetic defects, structural irregularities, or internal mechanical issues that existed before service, including issues involving surrounding cabinetry, flooring, or trim.
Customers must document and validate pre-existing conditions. Refusal to sign or initial this pre-service validation form at technician arrival results in immediate cancellation and a charge for the standard diagnostic and administrative trip fee.
5. Limitation of Liability
To the maximum extent permitted by law, Hermes Services LLC and its agents, contractors, and members are not liable for incidental, special, consequential, indirect, or punitive damages related to services performed, including lost property value or business disruption, except where gross negligence or willful misconduct applies.
6. Severability
If any clause, phrase, or subsection of these terms is found invalid or unenforceable by a court, all remaining provisions stay in full force and effect.
7. Binding Agreement, Costs, and Jurisdiction
The customer’s signature on an estimate, work order, or digital invoice confirms review, understanding, and acceptance of these terms. The customer also agrees to indemnify Hermes Services LLC, its employees, contractors, and successors from damages or legal claims arising from technical repairs, subject to the stated safety limits.
This agreement is governed by the laws of the State of Colorado.
Important Notice
The administrative dispatch, vehicle trip, and system diagnostic fee is strictly non-refundable once the service vehicle has been routed to the client’s property.
